Privacy Notice

1. Who is responsible for your data

This Privacy Notice explains how [COMPANY NAME] LIMITED, a company incorporated in Hong Kong SAR with its registered office at [REGISTERED OFFICE ADDRESS], Hong Kong ("we", "us"), handles personal information when you visit https://emsensehq.com (the "Site"), place an order, or contact us. 2. What we collect and why

We collect only the information needed to run the Site, sell and deliver products and support you:

  • Order information - name, delivery and billing address, e-mail address, phone number, the products you order, prices and payment status. Used to process and deliver your order, send order and shipping confirmations, handle returns and refunds, and keep the records the law requires us to keep. Basis: performance of our contract with you; legal obligation.
  • Payment information - your payment is collected directly by our payment service provider. We receive only a confirmation of payment, the card brand and last four digits, and a transaction reference; we never receive or store your full card number or security code. Basis: performance of the contract.
  • Support correspondence - the content of e-mails and forms you send us, and our replies. Used to answer you and to keep a record of how we handled the matter. Basis: performance of the contract; our legitimate interest in good customer service.
  • Site usage and device data - IP address, approximate location derived from it, browser and device type, pages viewed, the links or advertisements that brought you to the Site, and cookie or similar identifiers. Used to make the Site work, keep it secure, prevent fraud, measure how the Site and our advertising perform, and understand which products interest visitors. Basis: our legitimate interests; your consent where local law requires it for non-essential cookies.
  • Marketing preferences - if you tick the optional box at checkout, your e-mail address and order history are used to send you occasional e-mails about offers and products. You can unsubscribe at any time using the link in every e-mail. Basis: consent.

If you do not provide the information marked as required at checkout we cannot accept your order. We do not knowingly collect information from children under 16, and the Site is not intended for them.

3. Who we share it with

We share personal information only with service providers who process it on our instructions to help us run the business, and only what each of them needs:

  • payment service providers and, where you choose them, "pay later" providers such as Klarna, who process your payment under their own privacy notices;
  • the order-management platform we use to record orders, payments, refunds and customer contacts;
  • fulfilment partners and shipping carriers, who receive your name, address, phone number and e-mail to deliver the parcel and send tracking updates;
  • the e-mail delivery service we use for order confirmations, shipping notifications and (if you opted in) marketing e-mails;
  • customer-support and order-tracking tools we use to answer you and to show you the status of your parcel;
  • website hosting, security, analytics and advertising-measurement providers that help us operate, protect and measure the Site;
  • professional advisers, and public authorities or courts where the law requires it or where it is necessary to establish, exercise or defend legal claims.

We do not sell your personal information, and we do not share it with third parties for their own marketing. If the business that operates the Site is transferred to a successor, customer records may be transferred with it under the same protections.

4. International transfers

We are incorporated in Hong Kong SAR, and the service providers listed above may process your data in the United States and in other countries where they or their sub-processors operate. Where information about residents of the European Economic Area, the United Kingdom or Switzerland is transferred to a country that has not been recognised as providing adequate protection, we rely on standard contractual clauses or another safeguard permitted by law; transfers of data collected in Hong Kong are made with the care that the Personal Data (Privacy) Ordinance requires of a data user.

5. How long we keep it

Order, payment and refund records are kept for as long as needed to fulfil the order, handle returns and disputes, and comply with tax and accounting obligations (normally up to 7 years). Support correspondence is kept for up to 3 years after the matter is closed. Marketing data is kept until you unsubscribe. Site usage data is kept in aggregated or pseudonymised form; raw logs are deleted or anonymised within 14 months.

6. Cookies and similar technologies

The Site uses cookies and similar technologies for three purposes: essential cookies that make the checkout work and keep the Site secure; analytics that help us understand how the Site is used; and attribution identifiers that let us know which advertisement or link brought you to the Site so that we can measure our marketing. You can block or delete cookies in your browser settings; blocking essential cookies may prevent you from completing an order. Where the law of your country requires consent for non-essential cookies, we ask for it before setting them.

7. Your rights

Depending on where you live you may have the right to ask us for a copy of the personal information we hold about you, to correct it, to delete it, to restrict or object to certain processing, to receive it in a portable format, and to withdraw consent at any time (without affecting processing that took place before withdrawal).

California residents have the rights described in the California Consumer Privacy Act, including the right to know what personal information we collect, use and disclose, the right to delete it, the right to correct it, and the right not to be discriminated against for exercising these rights. We do not sell or "share" personal information as those terms are defined in California law. Residents of the EEA, the UK and Switzerland have the rights set out in the GDPR and equivalent laws, and may lodge a complaint with their local data protection authority.

Hong Kong Personal Data (Privacy) Ordinance (PDPO). Under the PDPO you may ask whether we hold personal data about you, request a copy of it (a data access request) and ask for it to be corrected (a data correction request); we answer within 40 days and may charge a reasonable fee for access requests as the Ordinance allows. We use your personal data for direct marketing only if you have ticked the optional box or otherwise indicated no objection, and you can opt out at any time, free of charge, by using the unsubscribe link or writing to us. Complaints about our handling of personal data may be made to the Office of the Privacy Commissioner for Personal Data, Hong Kong.

To exercise any right, e-mail support@emsensehq.com from the address used for your order, or describe your request in enough detail for us to verify your identity. We answer within the time the applicable law allows (normally 30 days; 40 days under the PDPO; 45 days for California requests).

8. Security

Personal information is transmitted over encrypted connections and stored with providers that apply industry-standard security measures. Access is limited to people who need it to do their job. No system is completely secure, and we cannot guarantee that unauthorised access will never occur; if a breach affects your information we will notify you and the relevant authorities where the law requires it.

9. Changes to this notice

We may update this notice from time to time. The current version is always available at this address with the date it was last updated. Material changes will be highlighted on the Site.
